Boult Wade Tennant Patent Attorney in London Matthew Ridley has contributed to the latest edition of the CIPA Journal. His article entitled “EU Registered Designs” provides a review of the Easy Sanitary Solutions BV; EUIPO v Group Nivelles NVCJEU appeal decision – a case which demonstrates how the indication of the product which is the subject of the design does not limit the scope of protection. The CJEU has confirmed that it does not limit the prior art either.
